Welcome to College Golf Guide. These Terms of Service ("Terms") govern your access to and use of the College Golf Guide website, applications, and services (collectively, the "Service"). By creating an account or using our Service, you agree to be bound by these Terms.

Please read these Terms carefully before using our Service. If you do not agree to these Terms, you may not use the Service.

Personal Use Only

Using your account to provide services to multiple families, or sharing your login credentials with others, is strictly prohibited and constitutes a breach of these terms.

Commercial use, including but not limited to use by recruiting agencies, coaches serving multiple clients, or any other entity providing services to multiple families, requires a separate commercial license.

Violation of this policy may result in immediate termination of your account without refund.

1. Description of Service

College Golf Guide is a college golf recruiting platform that provides:

• A searchable database of college golf programs across all NCAA divisions, NAIA, and NJCAA
• Coach contact information and program details
• Tools to save and track prospective schools
• Email communication features to contact college coaches
• School matching recommendations based on your profile
• Educational video content about the recruiting process

We provide tools and information to assist with the college golf recruiting process. We do not guarantee admission to any school or placement on any golf team.

2. Account Registration

Eligibility

You must be at least 13 years old to create an account. If you are under 18, you represent that you have your parent or guardian's permission to use the Service. Parents may create accounts on behalf of their children.

Account Responsibilities

When you create an account, you agree to:

• Provide accurate, current, and complete information
• Maintain the security of your password and account
• Promptly update your account information if it changes
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized access or security breach

Account Types

We offer different account types (Player and Parent) and subscription tiers (Database Access and College Bound Club). Each tier provides different features and access levels as described on our website.

3. Subscription and Payment Terms

Subscription Plans

We offer paid subscription plans with different features:

• Database Access ($99/year): Access to our searchable database of college golf programs and coach contact information
• College Bound Club ($299/year): Full access including school matching, email tools, tracking features, and video guides

Billing

• Subscriptions are billed annually in advance
• Payment is processed securely through Stripe
• Prices are subject to change with notice to existing subscribers
• All fees are in US dollars unless otherwise stated

Refunds

We offer a satisfaction guarantee. If you are not satisfied with your subscription, contact us within 30 days of purchase for a full refund. After 30 days, refunds are provided at our discretion.

Cancellation

You may cancel your subscription at any time. Upon cancellation, you will retain access to paid features until the end of your current billing period. We do not provide prorated refunds for unused time.

4. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Use the Service for any illegal or unauthorized purpose
• Send spam, unsolicited messages, or harassing communications to coaches or other users
• Impersonate any person or entity or misrepresent your affiliation
• Scrape, harvest, or collect information from the Service using automated means
• Attempt to gain unauthorized access to any part of the Service
• Interfere with or disrupt the Service or servers/networks connected to the Service
• Share your account credentials with others or allow others to access your account
• Use coach contact information for purposes unrelated to legitimate recruiting inquiries
• Upload or transmit viruses, malware, or other harmful code
• Violate any applicable laws or regulations

Email Communication Guidelines

When using our email features to contact coaches, you agree to:

• Send only legitimate, personalized recruiting inquiries
• Be respectful and professional in all communications
• Not send mass or automated emails
• Comply with all applicable email laws including CAN-SPAM

5. Intellectual Property

The Service and its original content, features, and functionality are owned by College Golf Guide and are protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of our Service or included content, nor may you reverse engineer or attempt to extract the source code of any software.

You retain ownership of any content you submit to the Service (such as your profile information and communications). By submitting content, you grant us a license to use, store, and display that content as necessary to provide the Service.

6. Disclaimer of Warranties

We do not warrant that:

• The Service will be uninterrupted, timely, secure, or error-free
• The information provided through the Service is accurate, complete, or current
• Any results will be achieved from use of the Service
• The Service will meet your specific requirements

No Guarantee of Recruitment

College Golf Guide provides tools and information to assist with the recruiting process. We do not guarantee:

• That you will be recruited by any college golf program
• That coaches will respond to your communications
• That you will receive athletic scholarships or financial aid
• Admission to any educational institution

Recruiting outcomes depend on many factors outside our control, including your golf ability, academic qualifications, and coach/program needs.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, COLLEGE GOLF GUIDE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, data, use, or goodwill
• Failure to be recruited or admitted to any school
• Actions taken by coaches or schools based on your communications
• Any other intangible losses

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

8. Indemnification

You agree to indemnify, defend, and hold harmless College Golf Guide and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Any content you submit to the Service

9. Third-Party Services

Our Service integrates with third-party services including:

• Google: For authentication and Gmail integration
• Stripe: For payment processing
• SendGrid: For email delivery

Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the practices of these third parties.

10. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including if you breach these Terms.

Upon termination:

• Your right to use the Service will immediately cease
• We may delete your account and associated data
• Sections of these Terms that by their nature should survive termination will continue to apply

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last Updated" date.

Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using the Service.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions.

Any disputes arising from these Terms or the Service shall be resolved in the state or federal courts located in Florida, and you consent to the personal jurisdiction of such courts.

13. Miscellaneous

• Entire Agreement: These Terms constitute the entire agreement between you and College Golf Guide regarding the Service.
• Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in effect.
• Waiver: Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision.
• Assignment: You may not assign or transfer these Terms without our prior written consent.
